Thanks for the update. Looks like this is one of the hottest areas going right now. I'm surprised there are any un-leased mineral acres available. Any available numbers would be appreciated. Before Argent took over, Denali was still leasing some acres up in the Muldoon area; but, were not very generous with their offerings.

Seth, I would be happy to share whatever we come up with in a lease. I hate doing anything in a hurry and it seems like having something put together and ready to negotiate on, then finalize with an attorney is the way to go. When my husband and I were looking at property to buy, we saw so many that needed cleanup of old abandoned wells/storage tanks, ... I want to be protected from that. Thanks.
From what I can discern, Argent (Denali) is leasing contiguous property (rather than large swaths of land) as part of what they call the "Briscoe Lands". Land they are interested in in the area of Andrew Wesley Chapel Cemetery are the Henry Tomlinson, George Evans, and Green Hardaway--though I'm sure there are many more on their radar that I don't know about. Argent (Denali) is putting a rush on trying to contact owners and send out lease letters this week. Pretty sad that they are known to not offer very much, however as was said in a prior post a guaranteed royalty would beat the odds. I will let you know what is offered in the days to come if I can get my hands on the material. I am under the impression that the Green Hardaway land is next door to land own by Pullins' that is currently active? May need to confirm that, but that's what I've heard through the grape vine. No word yet on the Jarrell Dale Moore place at 90 near I-10. Let me know your thoughts. I'm curious what the going rate for a lease would be as well. I've stated this before, I believe on the Fayette Co. Blog; but, here goes again. To some degree as with most things, this is a roll of the dice issue. There is ample data out there that says that as many as 85% of the people that are approached by someone offering money will sign the first paper or lease offered to them as long as they get their 30 pieces of silver. The following is a "HOT BUTTON" issue and will give some the heart burn; but, this is also documented information available in multiple seminars as well as book writings. Most people never think about anyone else; but, themselves. I'll be the first one to say that all of us need to think of ourselves; but, I also feel we have an obligation to be good neighbors and share information. Not all; but, most leasing agents like to keep things secret and close to the vest and they have all kinds of tricks and play all kinds of salesman word games to get "their" lease signed at the cheapest price. Denali and now Argent (one and the same) started out in 2008 offering $100/$50 for a 3 year primary and 2 year option and a 1/6th royalty. They sucked up a lot of acres since many people had their hand out ready to sign. As the activity picked up, bonuses as well as royalties increased until the later part of 2010 when much of the available acres had been leased. About a year ago, Denali started leasing mineral acres again, at least in my area; but, on a very selective basis since they were planning to drill and most often needed these acres to fill in on a pool. At that time, they started offering people $250 bonus and 20%. I'm not sure of the years; but, what ever they could get; but, in one case I know about they settled for approximately one year since they were going to drill rather quickly anyway. I'm sure they got some takers at the $250 number; but, most people settled for around $400. That sure isn't $1000 or even $1200 or the $1350 that Divine is advertising; but, if we are guaranteed a well, taking a lower bonus price might be worth it. This is just my thought. The lower bonus of around $400 with a very short duration lease time frame and a guaranteed well within one year and a guarantee that all my property or at least the majority (defined %) would be in the pool might be in order.
No depth restrictions as long as the lease is within the primary term should be acceptable; however, once the primary term has expired, the lease must limit the operator to the depth they are producing plus 100 feet or so.

Well I feel like I'm doing my part in informing everyone here about projections as I have come to understand them? I agree with your opinion nearly whole heatedly and understand that these companies will do ALOT to "get what they want", including taking advantage of people. SO again, I agree with your views of sharing information with our community. I will continue to do that so long as I have pertinent information to share.

I have two friends that are in house counsel for oil companies active in the Eagle Ford, South East Gonzales County area and they are paying $2,000 an acre and 25% royalty. Too bad that at this time they are not interested in my area. One of them is paying $2500 to $3500 an acre in Lavaca County for select leases. Thanks, Charlie
Yep! I don't know your friends or the situations associated with these numbers; but, there is ample reading material and documentation to support these higher numbers that come after the initial mad rush to sign everyone up. The big difference is that once the mad rush is over, they become very selective. Most of the time they are using seismic data to support their new leasing effort. If you're above what looks like a very productive area, they will be willing to pay the price. The problem is that the normal land/mineral owner isn't usually privy to the data that is available to the operators/leasing agents.

This is great information. Many of us aren't very close to the hot area; however, all it takes is an E-mail with some compiled information. Once the e-mail has been sent out, it's just wait and see. At least the information is in another persons hands and we can always say no.

These guys are experts at testing human nature and there are always a few loose cannons out there thinking they are going to get a jump on everyone else. There's no real answer except getting all the neighbors together and discussing the issues openly and there will still be some that always have there hands wide open just begging for the first morsel that is offered.

I am curious as you are who will truly hold out. I know Moore is. I know they are further away, but I wonder what the Hardaways stand to gain if they are to hold out too--I wonder if others on 1680 have held out as well. I suppose holdouts might stand to gain something form the the Mouton-ZaZa Prospect? Bigfoot I agree, some will have their hand ready to get whatever they can. But as you say, the hold out puts us in control.

Jst received word of increased truck traffic in the NE Gonzales County area, but within the Sitel Data Seismic (Flatonia-Schulenburg) area; whereas new pad sites are developing on FM 1680 (Old Moulton Road) btw CR 417 & CR 420 on the Westside of FM 1680 possible Argent (Denali) well and another at CR 405 & CR 401 possible Tidal Energy 2nd EF well! All, this continued activities are NW of both Newtonville (Halcon) and Crabb Ranch (ZaZa LLC) where gathering trucks were spotted too, picking up oil.
In addition, flaring activities continue at both Tidal Energy on CR 405 and Argent (Denali) on FM 1680 (Old Moulton Road) around CR 420 in NE Gonzales County. I'm told, that when the completion of the Conoco/Phillips "newly" build pipeline is completed then drilling activities will increase, since a lot of the leases will mature in the 2nd Q 2013.
This is of importance as the EF trend continues to expand NE Gonzales County to SW Fayette County with contiguous leasehold expanding SW and S to N and NE; and those who have land/minerals on the county lines (Gonzales & Fayette Counties) and underneath I-10 from TexDot purchase in 1968 expanding Interstate 10 East & West.
Also, it was said that Sanchez Energy was looking to expand it Hwy. 95 Prost EF exploration West in line with Halcon (Southern Bay) Newtonville Units, also seeking at least 2,000 acres of the 24,000 net acres of it's "non-compete" which BHP (PetroHawk) holds by agreement. When I heard this, and EP had not purchased and/ or any other, when the data room was opened last Q, gave me optimism that Halcon (Southern Bay) continues to operate and continue it's drilling operations in our areas.
Last, point ZaZa LLC has moved from the testing and onto it's development stages of it's strategy in approx. 2 years and have announced it's intentions to drill a new well this Q 2013 in SW Fayette County, where the entry is located on Old Waelder Road (CR 456) and I-10 East in SW Fayette County and less than 3 miles of Crabb Ranch and within that of Newtonville and other current production. However, the horizon is lit from the all the activity, I'm told!
Thank you for sharing this. I hope people will vote differently come next election time and put a stop to our erosion of rights. If things continue on the way they are, we will no longer be landowners or have any benefit from owning mineral rights. We need to make our voices heard. Thanks again, Charlie

Last week we sent an alert, urging you to send a letter to the Railroad Commission telling them not to railroad Texans’ property rights via new rules for the Mineral Interest Pooling Act (MIPA) – the law that authorizes forced pooling.
If you haven’t done so, it’s not too late to send a letter.
But even better than sending a letter, come say your piece in person.
WHAT: Railroad Commission hearing to consider whether to proceed with new forced pooling rules under MIPA
WHEN: January 30th at 9:00 am
WHERE: William B. Travis State Office Building, Room 1-111 1701 N. Congress Ave., Austin, TX
WHY: The reason the TRC is considering the rules now? Among other things, they want to legitimize railroading (hah!) small landowners -- who want no part of production/leasing -- into not just drilling, but PAYING for the drilling they don't want. If the well isn't profitable, new rules could wind up losing landowners money.
