All of the ones I have seen favor the Lessee. The usual top lease clause prevents the lessor from entering a top lease without allowing the lessee final right of refusal. So I feel a top lease has absolutely no advantage to the Lessor unless that is the only way they will enter the agreement with you.

I don’t like top leases restrictions. If I decided to negotiate a top lease with another operator, I want the current lessee to bring the money to the table. Not just meet someone else’s offer. I also don’t want to be caught in the notification process. I’ll simply give the lessee the chance to throw me a best number out there and choose from that.

was curious Ive received amended division orders for 4 more wells. How far back will they have to pay my royalties?

Rob, it depends upon whether the amended DO are for errors in title, hence changed royalty interest percentage or whether it is just a change in company that is buying production. If RI issue, hopefully they will go back to Day 1, plus any interest penalty (which sometimes you need to ask for). If just a change in buyer, then be sure and check your RI to verify that it is correct and it may be from date of agreement to switch over to new company. Keep track of all your paperwork!

Hello! We signed a lease last year in August with Norwood Land Services in Caddo County located: Lot 4 nw quarter (nw/4)sec 2 twnship 9N range 13 west of Indian meridian. We have seen Clint’s posts for Caddo County Oil & gas permits but don’t know if the posts are pertaining to the well(s) drilled recently in connection to our lease. Any information anyone might be able to share would be greatly appreciated.

There have not been any applications or permits issued for that section or the surrounding 8 sections in the last year.

Barbara, it depends upon where you are, so we need the S-T-R. Lease prices vary across the county.

If this is your first offer and it is with Bearcat, it is low……

Bearcat has been leasing extensively in the area. My suspicion is they are doing it for Marathon, but I do not know for sure. I have heard of offers for $850 in 7N-10W, so you might want to see if you can get more. Your other option is to wait for the Pooling Hearings to start and then you will have a feel for what the maximum offers will be. That is what I usually do. Stall until I know more.

Anyone here familiar with Bearcat Land, Inc.? They are offering me $750 per acre for a 3 year lease. Is that a fair price?

Make sure you have a depth clause, do not warrant title, have a no deductions clause and limit your shut in time clause.
