Thank you thats very encouraging info. I have been looking for the status of the lawsuit against cheasapeake. I have contacted the law firm, but havent heard back yet. I think I'll hit the internet some more. The lawsuit was filed in 2010 in OK also so maybe its been decided. Thanks Again

I heard the lawsuit was dismissed from Larry Wright, one of the attorneys for plaintiff.
Yes Im just finding that out . Im very upset. I wonder why it was dismissed. Does mister Wright know why? It looked like an open and shut case to me but im no lawyer. I wonder if the plantiff got payed off to drop the suit.

I think it was probably because all the leases are not exactly the same so therfore a class action suit could not stand. Oh well like I said at the begining of this disscission A big company stickin it to the little guy. But what goes round comes around. the ceo is in big trouble and the whole company will probably go under soon. Thank you and everyone who replied to me in this forum. This a good place to come for information and knowledge.

There are plenty of good people working at CHK. Lumping them all as being crooks and hoping the company fail isn't right. McClendon does need to go i agree but i have had many dealings with CHK and they pay my royalties on many wells in Oklahoma with no issues.

Yes sir you are right . I didnt mean to imply all people that work for the company crooks. I dont want the company to fail, I have leases with them. I was just frustrated because in my case it doesnt seem like they were being fair,and after some research I found that I was not the only one. So I really hope NG prices rebound and that CHK can deal with its problems. I have a vested interest in CHK, but no one likes to cheated . Thank you.

I have wells with Devon, EOG, XTO, and some other small timers along with Chesapeake. In same month production, after deducts CHK paid me as low as $0.16, all the others paid around $1.00. Now tell me they are not cheating us. I figure they are selling the gas to an affiliate at a super low price and then charging super high cost sticking it to us both ways. If anyone knows of a class action suit in Texas please get me info.
I think the critical point is that if they have decided to pay $0.16 a mcf that they will not go back to paying $1 or more per mcf/unit even if prices rise, and why should they, when they have already shown they can/will deal with the consequences? I have a question also that I wish someone could answer, if the producers are going to keep searching until they find a way to keep from paying you what they owe, what benefit is it to lease in the first place if it costs 100 times what you could possibly make if you have to enforce the contract? Personally, I would not like to be bound to a contract and receive $10, $50 or even $100 a month, just not worth the trouble.

Good point! Makes me even more determined to do whatever is necessary when leasing to avoid having to deal with CHK.

Royalty Underpayment Class actions are dead in Texas based on rulings form the Texas Supreme Court. Best avenue IMO is to get a group of royalty owners in the same well and pursue claims together.
