Also, there would be the issue of a PUGH clause in the original lease, as the Cothrom A10H does not traverse both tracts that make up the 80 acres. Since the lease is not currently HBP to the Federal Unit, then there is the chance you are being paid royalties on an allocation basis, which would have released some of those lands if the allocation does not include all of the subject lands. (from your lease, the source deed was referenced as DR (831/146), but if you read that deed, it cites two different tracts, coming from two different source deed title chains (thus, it is really those land in A-511 as one mineral tract and those lands in A-1013 in another mineral tract). It does not appear that the Marathon leases on that tract from those dates contained any additional provisions or language, so I do not think a PUGH clause would impact the lease.

you might also consider searching your father’s name in the Texas Comptroller’s dormant accounts website…if royalties sit on the books for awhile, they sometimes roll over to accounts there…
