My mother, who is deceased, received some legal notice, that was mailed to my sister on relief sought to establish a 640 Acre horizontal Drilling and Spacing Unit with Gastar Exploration USA INC on sec 19 18N Range 6W in Kingfisher County. I called Gastar and told them that mom was deceased, explaining she had 4 children which one had died and his kids were getting his share. Told them all this information was in Kingfisher County Court House where her probate was done and that she didn't actually owned the land but had mineral rights in the area that were passed down to all of us when mom passed. I am thinking the mineral rights is Section 20 18N 6W in Kingfisher County.
Today I get the same notice but from Lowry Land Co for a Waiver of Notice, Spacing Application CD No. 201404349, Section 19-18N-6W, Kingfisher County.
The cover letter states about halfway down:
"Thank you for phoning our attorney. The probate of "my mother" was not filed against the caption lands; therefore, her heirs were not included on the original notice of spacing. However, the lands are covered under the rest and residue clause of the probate. Gastar is required to give at least 15 days notice to all interest owners prior to the hearing on January 27, 2014 at the Oklahoma Corporation Commission. This Waiver is required by Oklahoma State Law and the Oklahoma Corporation Commission before the hearing will be allowed to take place; therefore, we are requesting that you sign the Waiver in lieu of Gastar refiling the Spacing Application."
The actual waiver says:
"WAIVER OF NOTICE AND ENTRY OF APPEARANCE PRO SE
COME NOW the undersigned Respondent, an interest owner in Section 20 Township 18 North 6 West, Kingfisher County, Oklahoma and waisve all statutory notice to which she was entitled in the above styled and numbered cause and enters her appearance herein pro se and grants to Gastar Exploration USA Inc., the Applicant, the right to include the undersigned, at the address below, as a Repondent to any future filings under Cause CD No. 201404349."
My question is, should I sign? Thanks for any information you may be able to give.
