Pooling leasing

Hi, I am needing some help. I currently have minerals in Section 32, township 18,, 6 west and received a pooling from Chesapeake along with a tax form to fill out. I currently have my minerals leased out to another company for another year and half. In the ppwk I rec'd from Chesapeake, they give three options for payment that must be made in ten days. Since my minerals are already leased, do I need to choose an option or just fill out the tax form and return to them. Thank you in advance for your help in this matter as I am new at all of this and do not understand all of the ins and outs

I see your lease filed, so you should not have received a pooling order. The safest thing to do is respond quickly to Chesapeake and tell them that you were leased with Company X as of date. Give them the book and page (if you don't have it, I can tell you what it is.) Then put in a backup sentence of "in case this is insufficient, then I pick the option (that matches your lease.) If you picked 3/16ths on the lease, then pick 3/16ths on the pooling. Be sure and put the Pooling order number, the case number and your description of your acreage in the letter. Send by certified mail, return receipt and keep a copy of everything you send. If Chesapeake sends you a check, I would not cash it until you get it straightened out because you would probably have to give it back. Once they have the book and page number, they will probably not count you in the pooling because you cannot be leased twice. UNLESS, you have a specific depth clause on your first lease for certain horizons and Chesapeake is pooling for different horizons. That is why you do the backup sentence.

Thank you M Barnes! I show the cause CD No to be 201600506 and Order No 651104 to the pooling. They actually sent the letters to the estate of my uncle and also one to the estate of my aunt. I have since faxed them the paperwork showing that a transfer was filed and that the minerals should be in my name. I do not have book and page number and would appreciate it if you could give that to me. One further question if you do not mind? Do I need to fill out the tax form they sent and send it in also with my letter telling them I am already leased? I did take the lease out of 3/16th. I really appreciate your help and all the help from this site as I do not know what I would do without you all. Thank you so much!

You do not need to fill out the tax form now since they will not be sending you any money. You will need to fill it out after the well is drilled and you receive the Division Order, so wait until then. Go ahead and send them the pooling answer letter just to cover all your bases. They sent you the pooling because of the aunt and uncle's possible ownership. The title work done for a pooling order is of a more general nature than the title work done for the Division Order. They are more detailed at that time since it involves the continuing payment of royalties.
