Enter JEEP, MARTHA SLEEPER in the Grantor field and click the search button.
Hypothetically, if the instrument/deed read(s) something like, “I [sister] grant and convey 100% of both my interest and my sister’s interest as described in the quit claim deed filed…” it could not be validated as to the OP’s 50% equal interest irrespective of the amount that was paid. I had no problem with the first part of your comment to which I replied.
Texasfile.com website Select Terry County. In the first line on left, enter your last name and then first name (Jeep Elisabeth). You will get the quit claim deed and oil and gas leases. If you enter your first name and then you last name (Elixabeth Jeep), nothing will come up. This is a quirk in the system.
A deed would never be drafted like that since each own as individuals, but if it were, the original poster would have to sign as well, since she did not, the deed would be invalid.
The quit claim deed said
Grantor Martha Sleeper Jeep
Grantee: Elisabeth Jeep and Robin Frances Jeep, in equal undivided interests, as their sole and separate property and estate.
Then a description of the property in Terry County. Dated November 21, 2013. It was recorded in Trey Co. November 25, 2013.
Yes, I agree. But please consider if she knew for a fact that her sister conveyed 1/2 interest not her own, it would require extraordinary language, and even then it could not hold which is why I took issue with the second part of your earlier post. I will concede that we had a misunderstanding, hopefully without hostility, and wish you well.
