Texas RRC Well Spacing to Property Line

Hello. I am considering purchasing a 33 acre tract with no mineral estate. Does the Texas RRC specify minimum spacing to property lines? I found a “rule 37” that says 467ft. Does that mean if the tract is narrow, say 750ft, that an oil/gas well could not be placed on it? Thanks in advance.

No. RRC rule applies to mineral tracts under lease, not to surface ownership. Purpose to prevent an operator from placing a well too close to lease line and draining adjacent minerals which are not included in well acreage. Distance from lease line varies by field rules for depth and formation.

If you are concerned about having surface control you (or the person you are considering buying from) would need to obtain a waiver of surface use from whoever holds the mineral interest. That might turn out to be fairly simple and inexpensive to do, or it could be uneconomical if not impossible.

Surface control effects the value of the property, so you might start by asking the surface owner what information they have about the ownership of the minerals.
