Affidavit of Non Payment

Where can I find a Affidavit of Non Payment form? I need to file one for Noble County.

Thank you.

Here is an example of a “release of lease”

You can find examples on www.okcountyrecords.com of how to fill it in. You do need the description, parties, book and page, etc.

Thank you for writing back, but I’m not looking for a “release of lease”. I’m just looking for an Affidavit of Non Payment for my gas royalties that I haven’t received.

You could modify the affidavit for your purposes. I could not find a template for Non-Payment. There may be one out there, but a quick look online did not find one. The operator would need the same information as to lease book and page, location, your name, etc. Owner number is helpful.

What well are you looking for and I can look it up and see if it is producing. If it is brand new, the first checks don’t come until about 180 days after first sales.

Or you can look it up on the OTC website, by either well name or location. https://otcportal.tax.ok.gov/gpx/gp_PublicSearchPUNbyLegal.php

If this is an older well, then check your Division Order minimum. If it is $100, then they will hold the royalties until they total that amount and then pay you. You can change that to $25 for more frequent payments.

You can also look up the well on the OCC website to see if it has been sold. That can cause a delay in payments. https://imaging.occ.ok.gov/imaging/OGWellRecords.aspx
