Hi, thank you for access to the group. I have inherited mineral rights 2 years ago located in Mountrail Co. ND. Hess is the Lessee. The lease was established in March 2008. Looking over the lease, I see it is valid for a term of 5 years AND as long as oil or gas is produced from the pooled acreage. The wells are still producing. There is 160 acres with location at: Township 155N, Range 93W Section 15. Being the lease is 12 years old, can I update it to any new/contemporary best practices now being used for extraction?? Should/can I renew the lease??
As long as there is production on the lease you cannot change it and you cannot renew it. The primary term is the five years and you are now in the secondary term since there is production. That original lease can hold you for decades.
