Being informed regarding royalties, drilling, etc

We own about 36 acres which has an oil lease but is not producing royalties, yet. As a question to those who are, can you tell me what I should do to prepare for the possibility of this phase of the program? I am very confused regarding horizontal drilling and how to protect my family's mineral rights(i.e., assure that we are compensated fairly for their drilling of our oil or gas horizontally which does not require a well on our property as I understand it). Thank you.

What is the survey and abstract in which your land is located? Are you included in a unit well that has been drilled and is producing? If you can provide the survey and abstract, it will be easier to figure out what is going on around you.

Thank you, It is of the Fernando Carillo Survey, abstract # 64. How do I find out if I am included in a unit well, etc.

There is a lot of activity in and around that survey. Who is your lease with, and who are the named lessors under the elase besides yourself?

My mom, my brother, and I are all 3 on the lease (with EOG) as we own the property equally. Even though there is a group of wells going in 2 neighbors south of our property, we have not heard anything re: pooling, etc.

Also, upon visiting our property yesterday it was brought to our attention that in one area which is typically in the flood plane, there exist cavernous wholes between 8" in diameter and 2-3' in diameter which seem to have just sunk down from the surface(up to 2 or so feet). Has this happened to anyone else's property? Thank you.

Is your mom and brother's last name Wilhelm? I ask only because on the P-12 forms EOG is required to file with the RRC, they list the tracts included in a unit by lessor name usually.

I am aware of this and upon looking on RRC, I don't find our name listed. So, are you saying that they are required to file a P-12 with RRC BEFORE they begin drilling operations so that I could be updated regarding 'planned' activity by monitoring the RRC website for additional listings?

Yes in order to get a drilling permit, they must file a plat and P-12. Monitoring permits is one way to keep abreast of what is going on around you and with your acreage.
