Can we see production numbers during probate?

My mom has been getting royalties on mineral rights in North Dakota for years. She recently passed away and we have to go through probate in order to get the rights into my dad’s name. They say it could take 8-12 months. Is there a way for us to see what production is during that time so we will have a pretty good idea how much royalties are being earned while they are not paying during probate? I understand my dad will get a payout for these months in a lump sum after the probate is finished, but we are hoping that we can know how much is being made each month during this process.

It’s a little delayed, but the operator has to report to the state. Go here: Oil and Gas Well Search and search for your operator then the wells. The operator would probably provide it directly too if you asked them.

You can ask the personal representative of the estate to provide that information informally. There may be a mechanism for such reporting under ND law. Obviously this adds to administrative/attorney costs so should be used sparingly or when you suspect the PR.
