David, Dan is right. I always insist on a depth clause anyway.
I suppose this is in Carter co. It must be in the West as XTO has just about everything east of I 35. Maybe you could contact RDWilliams in Ardmore and see if they are interested. RD does a lot of XTOs leases and XTO is showing interest in western Carter Co.
David, If you have 160 NMA, I would consider requesting a closing. This will escrow funds with a closing company just as you would a house. Another way I have heard about is to give a 60 days option to lease. They would pay 5-10% up front for the option and it is filed. After the clear the tiltle you should be able to lease with a cashiers check within the 60 days. I would also obtain someone to negotiate the terms on your behalf. The bonus amount may be the least important item in the lease.
What some people do after all the negotiating is done is scan the signed lease and email it to the landman. Tell him/her that the lease is signed and when the check is deposited and cleared, you will be glad to send the lease.
Other folks do a direct handoff. You hand over the lease, they hand over the check. (They hate this)
Other folks send a self addressed, stamped envelope and send one original and one copy of the signed lease (keeping a scanned copy for yourself). Ask that they return both leases stamped with book and page number of the filed lease for your records.
Others have their bank hold the signed lease until the check is cleared. Not so many will do this any more.
Make sure that your EIN or SSN are not at the top of the lease or anywhere in it.
If you have 160 acres, then you need to be careful about your clauses like Rick said. Gross proceeds for both oil and gas, depth clause, Pugh clause, limits on SI Royalty clause, etc. Do not sign the lease they send you! It is totally in their favor, not the mineral owners. If you are also the surface owner, then you need to be even more careful and get a really good surface lease as well.

There have been 11 leases signed total. 1 in 1981 and 10 lease since 11/06/2013. Apache seems to be the operator. Not telling how many landowners are in that section. Hold tight, I think things will get better and never except the first offer anyway.

Chris…Carter County has been very active…mostly east of the interstate and now around Healdton (3S-3W). I would sit tight. The first Continental Woodford well in the area is spudded in 35-3S-3W, and a pad is built for 10 & 15. I haven’t looked at pooling orders in Carter, but I believe its been ranging to $1,000/acre at 1/5 and 1/4 no bonus. Can’t find any 1002As or well logs that go deep in your section or offsets, so no idea if there is Woodford there. From Continental’s roadside diner map, you look to be right in the middle of the oil fairway there…and it looks like they may have leased acres in section 31.
When you get unitized, it is for secondary or tertiary recovery of the reservoir, usually for water flood or steam flood. The different operators band together, one is chosen as the single operator and they put all of their acreage in together. It will cover the whole reservoir, even where wells were not then drilling (or later). They re-apportion the percentages of royalty now based upon your acres in the whole unit. You get checks even if you don’t have a well. You may find a big unitization packet that was signed, or you might not find anything-just a single page or it might be lost. It won’t be a pooling document. I found the map on the OCC website with the packet. I am out of town, but check your friend page and I can help you when I get home. If you still get checks, you are still HBP. At this stage, the money may be so small, that you only get a check once a year. If you inherited it, it may be sitting for you in unclaimed funds.
