After filing a Compliant fro Quiet Title at the courthouse in Carlsbad for Eddy County mineral rights, many heirs seem to have come out of the woodwork. The will which passes these mineral rights down to heirs in my family has not been probated in New Mexico, nor the state in which the person owning the rights lived until death. How do I get this will probated in NM and how much is reasonable to expect for the service?
Check with an attorney in New Mexico, it may be possible that you can probate the Will there if there is no property (and thus no need) to file a case in the home state. Inquire about a flat fee if the matter is uncontested.
