Katrina, I went back to June of 2013 and could not find that neither well has been PERMITTED as yet, Doesn’t mean that they could have been permitted way back in 2012. What you really need to tell us is API number and date permit issued. Now if you have read Antero’s 1st quarter report this year, “report posted on this forum” within the last couple of weeks, they say a lot of wells to be moved out to 2016, not saying one of them is your’s, But???
Wondering if anyone has heard about any activity (well drilling) in the Big Run area of McClellan District of Doddridge County?

I just sent off to change documents into my name. I included a request for two things from the book records. I was sent back cash, not the documents. =(
The adding to the tax books without checking is now in question…
Their story is that whoever told me that is crazy…well, I sent back her name and extension at the Auditor’s office! Ba ha ha
With that being said…
The operator sent a royalties statement to the state with some folks long dead listed as receiving royalties. The state added them to the tax rolls because they aren’t listed any longer (when you are dead, that sometimes happens) thus, creating a tax bill, which of course, the dead folks didn’t pay. Sooo, the moral of the story is, be sure to check the county records periodically for your long dead relatives that were smart enough to leave you royalties! =)

Very good info, Stephanie P. You are having quite a time with this. And the WV procedures need review. Wonder if the legislature would pay as much attention to this as the forced pooling?
Can anyone tell me if using a Quit Claim Deed is the best way to pass on Mineral Rights to a survivor? I am in Ohio, Mineral Rights are in WV (Doddridge county). With a QC Deed, is it simply a matter of filing the document with the Court House in West Union and a copy sent to Antero as well? Thanks

Anna, As I understand a quit claim deed, you are just saying that if you own any interest in the described tract, or may e just any interests in a certain county, you are deeding it to the grantee. I have some recollection that this not the best way to do it, but don’t remember more about it. There might be more to do than what you described, but maybe not. Hope someone with more knowledge chimes in. Antero might have something on its website under Owner Relations about transferring ownership.

I just filed my Affidavit of Heirship a few weeks ago. Once you have it completed, gather all the supporting documents. You’ll need a page count. Call 304-873-2796 and get the total amount of the check to send with your paperwork. I included return address labels so that my paperwork didn’t get lost. It took about two weeks for turn around on the documents getting back to me. You still need to know that the tax ticket won’t change names this year. (I don’t understand this in the day of computers…but I know and will follow up…but put it on your calendar to call if you don’t see it NLT July 15th or so.)
After all your documents are returned, then you contact the operator. They will want everything you sent to Doddridge county AND the cover document that certifies it in the records as well as a W9 so that they can make sure that the IRS gets their fair share.
Mail it CERTIFIED RETURN RECEIPT!
thank you ladies, I was told by one attorney, as long as Mineral Rights are stated in a will that is all that needs to be done, and the will to be filed with Doddridge county. Another attorney told me even if it is in the Will that a Quit Claim Deed should be done (just like a house would be from Spouse to Spouse or other person). Antero pushed the Quit Claim Deed as the way to go. They told me, send them a copy of the QT Deed and copy of Will and it could be transferred easily. So now I am totally confused.
Antero also said both would have to be filed at the Courthouse in Doddridge.
P.S. Mineral rights make me CRAZY!!

An Affidavit of Heirship is the way to go. Doddridge County is one of the few counties in the state that still allows them to be filed. That is what the clerks office told me. I had a lawyer tell me the same story. I have one that I could share with you. Send me a friend request thing (whatever it is called, when you want to inbox someone.)

When my Mother passed away I called the Court House and asked “what do I do”? I was sent a copy of an Affidavit, self explanatory, followed instructions , sent a copy of Mother’s will, and death certification, and all holding were transferred into my name. Of course I am the only child and Mom kept excellent records so it was easy.
Nancy, yes during the lifetime of one owner and after one passes for the other. I have two, to handle. @Arnold, your situation is similar to mine, and the clerk at the Courthouse in West Union told me that is what I would need to do. She said it was very simple, just a form to fill out and produce the DC and Will to file for the transfer. She also told me I wouldn’t need an attorney. She never mentioned Quit Claim Deeds.
We had a will (my sister and I) but the will didn’t mention the mineral rights. (Because my mother had requested that they be transferred prior to writing the will, but it never happened…not because the paperwork didn’t get sent but because I failed to follow up on it and MAKE SURE IT happened)
After I submitted the will that had been filed with the local counties, they kicked it back to me. My TN lawyer suggested the affidavit of heirship, then one in WV disclosed that Doddridge County would accept that.
It took care of the situation.
