I’m looking for guidance to assist my aunt, who was declared heir in 2014, of 495 acres in Starr County, Tx. Her father passed in 1961 and had two wells (Sun Co) extracting oil on that property. She’s her father’s only child and just found out about the property in 2012. She does not have a title. Where do we begin?

When you say your aunt doesn’t have a title, do you mean she doesn’t have a deed or affidavit of heirship transferring her father’s mineral interest to her, or that there is a question whether her father owned those minerals?

When you say your aunt was declared heir in 2014, how was that done?

Where has her father’s royalty income from the two wells you mentioned been going since 1961? Have you confirmed that those wells are still producing?

Was the father’s estate probated? If so, you need to file an exemplified probate in Starr County.
