Forced Pooling in Colorado

How does forced pooling work in Colorado?

Hello, I thought I understood all there is to know about 'forced pooling' however, while attempting to explain the process, I found it difficult to answer a couple of questions.

My mineral rights are leased to oil company - QSR. Another oil company - Gulfport (GPE) - has begun drilling and is now pumping on the area where I have my interests. I rec'd an AFE from Gulfport last year, and after I contacted my Lessee - QuickSilver- was told to just disregard it since I am already leased with them. However, I would receive the royalty monies directly from GPE

I did disregard the AFE, however, I rec'd another Notice of Hearing regarding additional mineral interest owners who had not been notified.

How does GPE - the company doing the pooling - know if I am a consenting or non-consenting interest if they have never rec'd any correspondence from me? (I did not return the AFE)

Why am I receiving this Notice of Hearing?

Shouldn't I have rec'd something from Gulfport? Or will they be dealing directly with Quicksilver, my Lessee.?

Ms. Kelly, there are a few things that could be happening. QSR has either not recorded your lease or only recorded a memorandum of lease, or GPE just missed it entirely. QSR would probably like for you to ignore it because GPE finding out what the situation is, that you are leased, will just hasten the day that QSR will have to write the check for well participation. I would contact GPE and fill them in on the details, if for no other reason to cut down on my junk mail.

Mr. Kennedy, thank you for your quick response. I have contacted the landman representing both companies. I do believe I am becoming contemptuously distrustful of human nature. ha,ha. However, I was not impressed with either response. Having been in real estate for years, I do not like to rely on a verbal 'anything.' Anyway, this is my problem.

By the way - Mr. Kennedy, were you referring to your 'junk mail' being cut down; or the scenario of what you would do if you were me?

Ms. Kelly, I meant to state that in your position I wouldn't want to be receiving notices and AFE's for wells that I could not participate in even if I wanted to, I would consider them junk mail. I get enough fireplace starter already. I am sure that things will work out well in the end and hopefully they will quit bothering you. I think I understand what you mean about human nature. I wish you a good evening and a better tomorrow.

Pam, you are certainly not a nuisance, in fact , you and anyone else who asks questions are the very heart of this forum. If you ask a question and get five answers and I merely give my best answer, who has made the greater contribution? I am certain we would be much poorer without you.
