Fractional interest interpretation ? 1936 West Texas

What was conveyed by this “Mineral Deed”? This is in Texas. August, 1936. The grantor owned 100% of the minerals in a quarter-section (160 acres). The owner had signed an O/G Lease in July, 1936.

The mineral deed reads:

"… does grant, sell and convey unto said grantee an undivided 1/16th interest in and to all of the oil, gas and other minerals of every kind and character in, on or under those certain tracts or parcels of land . . . described as follows: The Northwest One Fourth of Section Fifty-Six (56) . . .

Thoughts?

Without knowing the title previous to this deed, if the grantor didn’t own in the NW4, the grantee received nothing from this deed. IMHO! You state “a quarter section”.

If you are referring to a full section at 640 acres and they only owned the Mineral rights of the NW/4 of the 640 acres or 160 acres of minerals. Then it appears they may have conveyed 1/16 of that to someone, or 6.25% of the 100% of the quarter section of mineral rights to that entity.

At least based on the limited information given that is what it appears? Like Todd alluded too, it could be nothing as well. It will all depend on the full mineral chain.

Determining exactly what was conveyed also requires a reading of 100% of the deed language, not just an excerpt, as there may be limitations or other language which affects the terms of the conveyance. In West Texas, you also need to be certain whether the seller owned fee minerals or whether the State owns some or all of the minerals in the tract.
