Hello everyone, Been on here for just about a week now and have another question about getting me and my sister names on the record of two sections that were our fathers rights in sections 33 and 32.
I found he had these rights when Continental sent out a letter back in 2008 when they were going to pool section 33 and when I called them they gave me a real run around and then just quit responding to me when I tried to get us on the record as the heirs.
Now they were attempting to pool section 32 and I protested to the OCC and they called me and then stated they would take our name off the pooling case and attempt to negotiate a lease on both sections. But they are dragging their feet now and I have since found someone saying anyone should get their name or names on the record (deed I guess) as mineral rights owners. I don't know how to do this as we are not in Okla and wonder if it can be done thru the OCC perhaps?
I have been contacted by someone from Minerman Land company that wants to do a lease and has sent me an affidavit of Heirship and I have filled it out and emailed it back to him and am now awaiting for him to finalize it and have me notarize it so me and my sister can be given a lease offer (which by the way is offered to be $550 and a 3/16th). Is that a good offer?
Meantime, Continental is so slow and I don't know if they will get around to offering a lease or not compared to how they did me back in 2008.
Any advice or tips, especially on name on mineral rights deed?
Adrian,where did you get the interest? Is it in 7n-6w? if it is I think you can get more if you take you time. I will get you some more info if you will give me some more.

Adrian, I found a notice of pooling hearing, and you protest, for 2-21-10 in 32 but no order yet . In the pooling for 36 Cont. was ordered to pay 500 for 3/16th or no cash an 1/4. In 22 they were ordered to pay 800 or the 1/4. I'll be back.
The mineral rights deed is recorded in the Grady County clerks office. If the original owner is deceased the current owner is determined by heirship. The deed doesn't change, just the owner. To get the current owner recorded heirship must be determined. The majority of the time this is done by probating the will. As a result of probate the current owners will be named.
When land is leased the cursory look to ownership is sufficient, but when the oil companies start making royalty payments on producing wells the look to ownership gets closer scrutiny.
That is not a good offer. What is the township and range?
Adrian, you don't have to lease, you can make an election under the pooling. There is a horizontal well in 29 that tested at 115 bod and 2400 mcf. I'll see if I can find what they were ordered to pay on that.
Ron, yes it is 7N-6W in both sections 32 and 33. And thanks for your reply and effort.

It can all be handled by mail. There is no need to worry that the rights are not in your name, because John Harold Madison is listed in the pooling so your interest is implied. And it's okay that he is listed in the pooling because you can still make an election as his heir after the order is issued. It appears the pooling is being mailed to an address in California, so you need to tell them to notify you if they get an Order from the Corporation Commission. You will have at least 15 days to respond to the order & make an election. They will list several options based on what they are paying in the 8 sections around you. How many acres do you have? You might be best off with 1/4 royalty but we can discuss that later. Let me know if you have any questions so far.

Hello again and so glad you are taking time to discuss this. You are right in that one son of mine was contacted and he called me and told me of the date of the pooling case on section 32 (current section and case) and I did send a letter of protest saying that Continental Resources hadn't acted in good faith back in 2008 and I wanted to have my protest entered in record of the forced pooling case of Feb. 21, 2012.
When the case came up and Continental was advised of my protest a Justin Biggs of Continental Resources called me immediately and told me he was dropping us from the pooling case and would work on negotiating a lease by way of a Aaron Ivey of Jackfork Land. So, our sections were taken out of that pooling case ( #201200575).
So, where does that leave me and my sister now? I had been touch with the OCC and have looked around their site and even talked to a Mr. Micheal Decker and someone in the consumer complaints department and she gave me some figures of what adjacent land leases went for to do some comparison to the offer I got from a Mr. Collin Waldrop of Mineralmen Land Co.
I do understand you when you say for my son to be on lookout for another letter possibly? As I now understand, with us out of the pooling order on that case, we won't be getting anything regarding that pooling, correct?

Adrian, are they pooling more then 32? If not I would not worry about anything but 32 now. Should get more $ later I would think with all the wells. After what you said I am not sure if you will get a copy of the order. Back to the lease, what are your thoughts about 800 for 3/16, or no cash and 1/4 royalty, that could be what you have to pick from. Also do you know how many acres you have under 32?

Back in July of 2008 they were sending letters about section 33 and now just 32. My dad has 2.5 net mineral acres in 32 and 15 net mineral acres in 33. I will ask Continental if they did indeed pool my dad back in 2008 but Continental did tell me he withdrew my dads rights from the pooling case on Feb 21st. Of course, there are 2 of us children left alive now so know we spit the profits if any at all. Yes, $800 an acre for 3/16 is good and even a lesser bonus and a 1/4 is up for consideration too. The guy from Mineralmen Land was saying $550 for 3/16.

If you are dismissed from the pooling you are not able to make an election under the pooling. Instead you will need to sign a lease agreement with someone. I would think you should receive AT LEAST what is ordered in the pooling. If they did not dismiss you from the pooling, you will need to make an election under the pooling, which is not necessarily a bad thing. If you have any questions about regarding the pooling you can call Donna w/ the Oklahoma Corporation Commission @ (405) 521-2613. You can also call the attorney listed on the pooling with questions and concerns (David Pepper 405-235-7000). In the mean time contact the other land men and ask for there best offer, and tell them you will not be renegotiating & you would like more than one option. I would seriously consider a 1/4th royalty option on 32. Also, I would not commit on 33 at this time. Ron, yes I was removed from the pooling order case ( I believe I listed the case # before here) and a guy named Justin Biggs from Continental has a guy from Jackfork land that is suppose to be contacting me to negotiate a lease since that was the trade off for them dropping my dads rights from pooling on section 32. Now it seems that in 2 weeks, the guy from Jackfork land ( Aaron Ivey) cant seem to call me as promised by Justin Biggs of Continental.
I am working with a 2nd company called Mineralmen Land and have sent an email to Northwest oil and gas as they offer to lease rights or even buy them, but wont see the rights myself.

Along these lines, suppose you are an heir, but you do not find out about the pooling until many months AFTER the deadline. Are you still able to elect an option under the pooling order, or do you have to go with the default pooling option they select?
