Help about Well Info

S&M Oil. Well, Nelson 11-12. twn.150 range97 sec.11,sec.2 NDIC. had no Info. about Well.It came off confadental June 12th.Any Info. would be greatly appreciated.

The well draining sections 11/2 in twp 150 range 97 is named Nelson 15-11H. The NDIC says the wells status is DRL which is drilling, but that was from 1-3-2012. I think SM Energy is behind on their paperwork as the well does have respectable production 49,965 barrels in 97 days of production (through june, which is the last month I have data for). First sales were probably sometime in March. In ND the operator is supposed to pay within 150 days of first sale or they owe interest on payments more than 150 days past due. In real life you have to have excellent, unblemished title or some operators claim a title problem as the reason for late payment. I hope you have any necessary probates done and a mineral deed in your name recorded at the county courthouse. I think you should be expecting a division order within the next 60 days or so and that if you do not get one I would contact SM Energy to find out what is going on. You seem to have a good well, not a monster, but good. I hope this helps.

E-mailed S&M Energy about 3 weeks ago but they have not responded ? I still don;t know when the first barrel was sold ? I'm asking for help too get an idea on what course of action to take next?

Your well produced 25 days in July 5,123 barrels,55,088 total cumulative. Since these wells do not ordinarilly decline 50% a month, I would hazard a guess that your well is not being produced as hard as they could for any number of reasons. Now for the bad news. If you leased to SM Energy or anyone else, then they are over you. You are last weeks news because there is nothing more they need from you at the moment. It's sort of a don't call us, we'll call you situation. It is about time they contact you so I would shoot them a few more emails and possibly call. Mr. Kennedy, I recived a division order.But with a Requirement letter? Stating that North Dakota probate proceedings should be completed in the Estate of my mother,along with copies of unrestricted letters,certified on or after the date of deed,conveying all of the deceased's interests in tract Nos. to me. How do I go about geting this done? When I leased with Dale I sent them my mother's Death certificate and proof of Heirship forms. I thought that they would have taken care of this?

Mr. Payne, if you have not probated your mothers estate in the state of North Dakota, this is what SM wants you to do. Even if your mothers estate was probated in another state you will have to probate her estate in North Dakota, which should result in a deed in your name which should be recorded in the counties in which the minerals lie. SM may require that you send them a certified copy of the resultant deed. I have been hearing that the probate of a relatively simple estate can cost between $1,500 and $2,500. I would suggest using a lawyer located in an eastern county as far from the oil patch as you can because you can probate in any county and it may well be cheaper and/or faster in a county with no oil production going on. Sadly, SM will not be paying you royalty until this is done. Production is up to 59,876 as of August, I don't know how many acres you have but if you have more than 5 they are probably holding enough royalty that you would get your money back after the probate and getting the minerals into your name, but you would be out of pocket until that time.
