If I have mineral royalty interests in 80 acres and there are 8 other individuals on the deed reserving the interests. What happens when individuals die? I know their heirs inherit the interests, but does this division or fractioning affect my interest? If my father owned the mineral royalties, he dies and now there are 4 heirs that must divide it between us. How does that work?
Assuming each of the 8 own equal shares, they would each own 10 acres. In your case, you and your siblings will own 1/4th of your father’s 10 acres or 2.5 acres. In general, each party owns their separate interest that is not affected by the heirship of any of the others.
