I HAVE SOME MINERALS IN TEXAS FROM MY GRANDMOTHER I'AM TRYING TO GET HER SISTERS AND BROTHERS ROYALTIES BUT THEY ARE ALL DEAD WITHOUT ANY LIVING KIDS . ONE HAS A SON BUT UNKNOWN IF HE IS STILL LIVING OR NOT I JUST WANT TO COMBINE ALL THE MINERALS SO WE DON'T LOOSE THEM . WHAT DO I NEED TO DO
Stacy:
I would consult with an attorney and possibly create an Affidavit of Heirship and Marital History detailing the births, deaths and marriages of these relatives. The purpose of the Affidavit is to create a record chain of title. The document must be recorded in the County where the minerals are located. You mention that one relative had a son so if he is living or any living relatives from any marriage would have to be found. Again, a chain of title must be created. Also, I would contact an attorney located in Texas who is familiar with the laws governing these matters.
You also need to consider whether any of the relatives had probated wills.
i will have to check on this unknown about wills thanks for your input
