What is meant by: Example.... Tract No. 1, an undivided 1/5 interestin and to 3/4 of the following described mineral estate? AND... undivided 1/5 interest in and to 3/16 of the following fee mineral estate? How is each figured and also, other than the obvious fractions stated what is the difference in the result/s when the work "fee" is injected or not included into the description?
Hope some one can help me understand.
Thank you,
Sandra B
Sandra, I'm not an attorney. So I'm sure this isn't a complete answer, but in general the "fee minerals" just indicates those minerals are privately owned by you and whomever.
As to calculating your interest;
IF Tract No 1 were 40 acres in size: 40 acres divided by 3/4th = 30 net acres.
30 net acres divided by your 1/5th = 6 net acres you own.
IF you have that additional interest also in the same Tract No 1 (possible from another inheritance);
40 acres divided by 3/16th = 7.5 net acres.
7.5 net acres divided by your 1/5th = 1.5 net acres you own.
In this example, in total you'd have a 7.5 net acre interest (6 + 1.5).
Though run your numbers yourself as I arbitrarily called Tract No 1 as 40 acres. Undoubtedly Tract No 1 is not 40 acres in size. Good Luck.
Thank you Eastern MT.
I will run the numbers on my interest and see how I come out. You've been a great help.
