The contact person for our non-active family llc listed on our mineral rights deed has passed away. How do members of my family update their individual information so it will be on record with Richland County? If a company wants to lease our rights, is this where they would find us? Last lease was 2012. Thank you for any advice.

You are not updating the deed, just the contacts for the LLC that owns the deed. Contact the recorder of deeds at the courthouse and ask how you can update the address for the contact person or persons. They may have an affidavit of address change. If there are only a few owners, put everyone on the change.
There is scattered leasing across T 26N R 55E and R 56E in the last three years.

We need to update the deed with the individual nine members (or their heir in the case of the three that passed). The Clerk and Recorders office suggested we get an attorney to update the documents. None of us live in Montana. Can we complete the affidavit without using an attorney?
You will need to create a simple affidavit of address which will supply all of the public contact information. The affidavit needs to include all of the property descriptions. The affidavit must be notarized. Since the LLC was not renewed, were the properties distributed or are you planning to distribute? You are looking at some future issues if you have not addressed distribution of properties.
Thank you for your input. The deed on file lists the LLC name (with incorrect contact information) and a 3-page affidavit, with property location, signed and notarized by each of the nine LLC members. This was done in 2010. There has been no lease on the property since 2013? and the LLC has lapsed and everyone just forgot about the mineral rights. I’m just trying to make it as easy as possible for us to hand down our 1/9 share to future generations. Also, IF an oil company wants to drill on the land, it would be nice to have everything in order.
