My mother-in-law inherited mineral rights. Her husband passed without probating her will. His daughters are in charge of the estate. My question is, how can we find out the status of the mineral rights, in regards to ownership & drilling. We would like to know if they have been sold or given a way, are royalties being paid, if so to whom or are they uninterested in claiming their rights.....is there a website where one can go to check on ownership of specific mineral rights & production on a specific property.
The first question that needs to be answered, is who inherited under your mother-in-laws will? That will have great bearings on your husbands rights.
DDS,
Having managed through several situations similar to your husband's, I recommend the following,
1. Take the legal descriptions in the will to to an independent geologist familiar with Logan County and ask him or her to find out what the economic potential is for the minerals may be. If it is over $20,000,
2. Take the will to Buddy Cotten or Wade Caldwell, members of the Forum or your local estate lawyer, for recommendations as to a solution and cost to capturing the potential. You must get Oklahoma law on your side.
For consulting costs of $2000 or less, you can figure out what plan benefits you best. A fair amount to risk for knowledge of the potential available in Logan County going forward.
For the name of a knowledgable Oklahoma geologist unaffiliated with Logan Gouty Operators, you may contact me directly.
If you do not get help from the county assessors office then contact a Mineral Rights speciliast/attorney.
Thank You.
