My uncle recently passed away in Alabama we both have inherited royalties him through his mother me through my grand mother his will is in Alabama and his assets are so little that we should not have to probate the oil royalties were left to me in the will we have sent a copy of will and death certificate to all companies involved but are being told the will will have to be probated. We had no trouble when my mom passed away but this has become an ordeal anyone else felt with this my aunt is deceased and there were no children the will is quite specific
Companies are getting increasingly particular about title work. Depending upon where the mineral assets are, some states do require a probate. Depending upon the type of probate, it can be easy or quite difficult.
I’m sorry for your loss.
You said his will (residence, I assume) was in Alabama. Are the producing properties in Alabama as well, or some other state?
Best wishes,
Buddy Cotten
