I have some minerals at Section 24 T9N R4W. There has been a lot of buy interest lately. This interest had production previously, but I have never gotten a check on it. It was leased by some of my wifes relatives before we got it. I never have gotten a release of Oil and Gas lease for it . If they decided to re-drill it, would I still get a lease bonus check?
There may be one well still active in that section. Whether your wife would get royalties depends upon the location of her minerals with respect to the location of that well. Assuming that she is not getting royalties, then the old lease is probably defunct. However, you might want to check just to make sure that the probate was done properly and there are not funds being held in suspense. Chesapeake has the current well.
Either way, if there is new drilling that includes your particular minerals in the new spacing unit, the inheritor of the minerals would get royalties. If you are already leased, it would be under the terms of the new lease. If not leased, then you would get to lease again and get the bonus and then eventually any royalties from new drilling.
