I recently found a mechanic’s lien letter in my recently deceased father’s papers. It was filed against our property in 2019. I have twice contacted the company that filed the lien for a status on the lien, but they are not responding. No lien is showing on our property at the county clerk’s office. Any suggestions how I can ensure the lien has been lifted.

Hi Tim, The property is in Garfield co, Oklahoma.
A mechanics & materialman’s lien is considered to be stale and unenforceable if no suit was brought to foreclose within one year of the recording. Assuming no suit was filed, you can ignore this. BTW, the lien is really an indication that the claimant plans to file suit to foreclose it. It is not a judgment by a court that the money is due and owing. this can only happen after a trial or court proceeding.
