Mineral Rights Inheritance

Hello, I have inherited a wide spread of interests in Stephens County Oklahoma, Sec13 T1S R4W. These include MR, ORRI, and WI. Two of my operators (Citation and BCE Mach III) are requiring that I provide the actual deed for the minerals to complete the transaction. Trouble is that I can’t find anything on OKCountyRecords.com or any other source for that matter. These interests were all purchased approximately between 1980-1989. I am in Texas so it’s I’m having extra trouble with just not being there. I’ve already hired a lawyer here in Texas and now the two companies previously mentioned are requiring an ancillary probate and that’s going to cost above $4500. I’m just a college kid trying to navigate my way through this. I’ve already learned so much and I’m eager to learn more! If anyone could provide some information it would really help me out I’m sure. Thank you!

If you want to locate the source deeds or decrees, you will probably have to hire a landman to track them down.

As to the probate, unfortunately, the companies have the right to ask for this to be done to have clear or marketable title. This protects them. You’re going to need an Oklahoma lawyer. Your Texas lawyer can only do so much.

If affidavits of heirship are not accepted by the oil companies (which most do not in Oklahoma) then you would be looking at a probate. Also, AOHs might not be appropriate for ORRIs or WIs. $4500 is a little high for an uncontested probate involving only Stephens county. You should shop around.

A landman may be able to discover the source deed or transaction. Therefore, you might not need to travel to Oklahoma. For an uncontested probate, it is rare that your attendance would be required.
