My mother has three plots of land in the Marietta City limits and has been approached by Emperador for selling her mineral rights to them. Two properties are in section is 20-7S-2E.
is this a legit thing? I’m really suprised they would be trying to buy rights in town but I have ZERO experience with this. I’m trying to make sure my mom is not getting the run around and getting her hopes up of a payment. They’ve sent over a contract which I’ve told her NOT to sign until I research more.
Any help or thoughts around this would be GREATLY appreciated.
As you can see, horizontal wells can be drilled from a location outside the town limits and under it to produce. XTO had plans to drill into her section back in 2019. They have been very active in the area. Drilling slowed down in 2021 due to Covid, but new permits in the township are showing up again. XTO filed the Miller 1-28H20X17X8R in late 2021. I suspect that is why she is getting an offer. The well spud in October. She may want to wait and see what her royalties are.
She needs a CPA to look at the offer and maybe an attorney. I would not be inclined to sign any contract without an attorney looking at it.
She needs to consider capital gains possibilities, what her intentions are with estate planning etc. This may be the first of many wells, so that is another thought. Proceed with caution.

On that map above, is there a legend? I see the dotted lines with a “p” on it and guessing the icon in the NW corner of 28-7S-2E is the well site? Additionally, the icons in the center of each section appear to have some meaning.
The P means permit. Sometimes they file various locations before they decide on the final one. The orange dots are for the OCC cases. She should have been getting notices from the OCC and she should have been either leased or pooled before this well started.
Thanks. Is there some way she can search the OCC for notices that may have been sent to her or anything? She doesn’t have anything but she also could have thrown it away. i’m guessing that she wasn’t part of a lease or pool or she’s not aware of it if she is. Thank you all in advance for helping.
XTO pooled 20 in 2019. Case 201810462. She can look that one up and see if her name was on the respondents list. The well she is interested in is called the Miller 1-28H20X17X8R.
