I signed a lease for Sec 2 6N 3W , May 15th ,2019 with Rock Creek Land and Energy for Native Exploration. So far, haven’t received the funds that was stated on contract. Can you tell me what is going on with situation?
This situation is a good example of why not to hand over a signed lease without getting paid. Did you have a draft payment letter with the paperwork? If so, have you followed all the directions in it? Search on www.okcountyrecords.com and see if the lease has been filed. Send a certified letter to both Rock Creek Land and Native requesting payment or return of your signed lease. You may have difficulty getting that lease back.
thanks for the information, did receive an order of payment at the time of signing the lease. Could not find where lease had been filed in McClain County. Will follow with certified letter to both companies. Lesson learned
Consider consulting a lawyer rather than relying on advice from the internet.
At this point, you are in a sort of limbo land which requires some legal help. They have your lease, but have not filed it. You have not been paid. Luckily, the pooling order that was scheduled for that section was dismissed. It may mean that Native will not drill and doesn’t want the lease to be filed. In that case you want that document back in your possession. Or they may want it filed so they can sell it as part of a package. Maybe they are stalling to get the money from the sale in order to pay you. Wouldn’t be the first or the last time that has happened.
It would be wise to consult an attorney.
Thanks again , have made an appointment with an attorney.
