I have had offers from a land-man to buy my minerals $1200+ Per Acre + Bonus.
I have no deed, clerks office has no record, land-man wont help me, just buy the minerals.
My brother was approached for his minerals same thing, he sold them and now his deed shows up in the OK county clerks office but not before.
I still receive checks, division orders and government docs. I have searched everywhere.
Any suggestions to clarify mineral ownership, deed? it is getting a little ridiculous now.
Thanks, Ian
The Land Operator ran title before making you any offer on your mineral acreage. If you and your brother had identical shares in this property, then look at his descriptions and you will know what you have. Land and Title professionals also do "curative" work correcting title issues when the bulk of information is there, but one or more minor defects exist. Tell the mineral buyer you will consider the offer after you are furnished with a title abstract on the tract identifying all owners and a take off sheet showing chain of title. You certainly must know exactly what you have before or if you wish to sell your interest. Also perhaps contact the operator of the producing well and request title info from them.
Do you own any of the surface? Did your family own any of the surface? If you do own surface, you may not necessarily have a 'mineral deed'. You could own minerals underneath that may be traceable back thru your abstract for your property. I've seen the mineral deeds when the minerals are 'split' from the surface.
Yes Go Fast is correct, if you are the "fee owner" of the estate both surface and mineral, then no separate reservation of minerals would be in the title record. If the minerals were not reserved when the property was sold then they are owned by the surface owner,
It is possible (just a possibility) that your father, mother, grandmother, grandfather, etc. owned the interest and you inherited it as an heir.
Its also possible that the landman doesn't know where you received your minerals, but he found your name on a spacing or pooling application, and if you accepted his offer, he would run title at that point.
All positive information, Thanks.
