I want to make a TOD for my mineral rights. My mineral rights are in Caddo County, Oklahoma. I live in Texas. My question is this—can a Notary in Texas sign the Oklahoma form?
Yes. The notary is only validating you as the signatory party. Nothing else.
Yes. That is perfectly fine. Make sure that the notarial statement is:
State of Texas )
) ss.
County of ____ )
of course fill in the county where the document is actually signed.
Also make sure that you use the Oklahoma form. Let your beneficiaries know what you have done and most importantly let them know that withing 9 months after your death they must file an affidavit claiming the property. Otherwise it reverts to the probate estate. Not legal advice here, there are many reasons to use or not use a TODD depending on circumstances.
