I own minerals in Blk A Sec 9, A-15 with royalties being paid on them Pembrook lease. The lease was written in 1934 and I have a full ownership record. Strangely, I have also received royalties for wells in Blk N Sec 4, A-897 for wells also listed as being on the Pembrook lease. I have no record of ownership in this section. That doesn’t mean it doesn’t exist but I have not yet found it. These other wells are very small and old but there are new permits in the section. The Operator won’t answer any questions about it until title is run after production begins. Is it possible that these other wells are in a section I don’t own but am receiving royalties on because it’s on the same lease and comingled? I’d like to understand this better in case these new permits become productive wells - or even if they don’t, I’d like to better understand how leasing works across sections owned and potentially not owned.
Pembrook Unit covers many sections. The recent horizontal permits list 43,109 acres. For unitized tracts, you are paid royalties on all the wells drilled within the unitized acreage and depths. Generally, mineral owners within the unit are paid on all the wells within the unitized acreage, You will have to research to see how the unit is organized and whether you are being paid on all the acreage or a smaller section if it is made up of multiple smaller units. You should be able to find the DPU (declaration of pooled unit) on line which will give you some information about the acreage and tracts. Hopefully, someone with knowledge of the unit will be able to provide information.
That’s very helpful. Thank you. I will find the DPU and dig through it. I did see a map Pioneer submitted as part of the permit process that defines the 43,109 acres. There is also a depth severance on it so it’s a complicated one. Of the 17 new permits in A-897, 14 are on the Brook lease and 3 on Pembrook. It will take me a bit to sort out. Pioneer won’t comment until they run title.
Looks like you have it figured out. Good info from TennisDaze. I own a royalty interest in the Pembrook unit and this all aligns with what I know. The Pembrook is unitized only specific depths and covers the 43,109 acres. Other zones will be pooled on acreage basis.
Do you know if the wells listed under Brook are included in the Pembrook Unit. I’ve been paid royalties on Brook wells previously but can’t find anything that ties these new ones to Pembrook even though they’re adjacent.
There are a bunch of Brook wells. Some are drilled to the Spraberry formation (unitized interval in Pembrook) and some are drilled to the Wolfcamp (not unitized in Pembrook).
Looks like most of them are wolfcamp wells though so not tied to the Pembrook Unit.
