A company wants to obtain an easement to build a road across an entire section. What should I negotiate for?
We were recently offered $50 per rod by Energen which is the figure used by UT land.

Things to consider:
Temporary easement or permanent easement.
is it a metes & bounds description [definite location & path] and does it have a fixed width?
Is it limited to certain types of traffic?
Are they going to provide you with an "as built" survey once the road is completed to verify the road is actually within the easement?
There are probably other considerations, but those come to mind.
A land lawyer would be a good person to consult.
We were paid $100/rod and $125/rod on 2 separate occasions for permanent easements. Key here is permanent.
