Hello everyone around Dewey county ok. We have land northeast of oak wood. The land has been in the family for many years. They want to run a 16 gas pipeline through our property to the west. For 300 dollars a linear rod. Nothing else. It will tear out lots of our trees which we dearly love. Told them we will not accept there offer. People need to realize the linear rod is only the length of the pipeline not the with of the easement on top of the linear easement. They will be destroying lots of trees and basically be getting free land. They said they would go around but might come back to negotiate. It costs millions of dollars per mile for them to lay pipeline. In one year they can make millions to a billion off of production. Landowners need to start standing up to these companies, landowners are winning in condemnation proceedings and trials more and more nowadays. The companies still get to lay the pipeline on there land in most cases, but the companies are having to pay dearly for it. Landowners are starting to wake up and fight back and are winning. Lots more money for their property. It’s about time. More people need to stand up!! The company is Derby exploration. With thoroughbred gatherings negotiating the pipeline. It’s crap pay people. Please wake up. Ask for more money. Lots!!!or they can go around. Remember they make millions to a billion dollars running their product through our land for shit pay! Long term effects too. Don’t let them bully or threaten you. They want to get your land for as cheap as possibly. While they continue to make millions of dollars. Thank you.

I believe that you are discussing a gathering line from oil/gas being produced from minerals that are not tied to your surface. Therefore, the company does not have the right of eminent domain. In these cases the company can pay the landowner, or go around. You also correctly point out that they are not seeking a lineal rod, but also a width of property for a working easement, then a permanent easement. This may be known as a private easement agreement.
In the case of eminent domain, the landowner is often left with only fighting over the value of the property taken plus the diminution of value for the remainder due to the taking. If no agreement is reached, a company that is a common carrier may have the ability to resort to judicial proceedings to take the property and have the value determined through the case.
In either case, the landowner has the ability to negotiate the value, easement width and route.
