Possible new mineral discovery

In reviewing older family documents pertaining to minerals in Grady County, I have discovered a Mineral Deed from my aunt to my mother recorded in March of 1985.

(My aunt was a missionary in India at that time, both women now deceased). These minerals eventually became part of a Family Trust. They are the N/2 NE/4 SE/4 and SE/4 NE/4 SE/4 of Section 15,Township 4 North, Range 4 West, containing 30 acres "more or less", quoting from the deed. Does anyone know of any activity in these areas?

This is in Garvin County south of Lindsay near Erin Springs.

Thank you Mr. Moore. But this information beings up another question. Is the original deed in error, or was Grady County sub-divided into Grady and Garvin Counties after the deed was recorded in 1985?

The original deed should have stated Garvin, County. I have a mineral interest in 17 4N 4W in Garvin County.

Cassandra, Tom is correct. The legal description you note is in Garvin County. Is there recording stamps on the deed? Maybe it was filed in the wrong county. I do not show any current production, but there is atleast one well that just shows inactive. Production ceased on most wells in 2004 and the one that shows inactive in 2009. They were not big producers. You might check with the state of oklahoma unclaimed property fund. Run both your aunts name and your moms. They should have turned any money over to the state that was not paid on the wells.

Upon further examination of these documents, what I actually have is an assignment of benefits from my aunt to my mother of 2 areas, one in Jefferson County of approximately 10 acres, and the one that is described in here as being in Grady County. This document is stamped by both the Jefferson County Clerk on May 15 of 1989, and the Grady County Clerk on June 9 of 1989. A couple of questions are coming to mind; 1) Would not the Grady County Clerk have known this was in Garvin County? and 2) what do I need to do to correct this? I believe the 2 wells that have ceased production were Chitwood (Cunnigham Sand), and the Britt Ordivician, because I remember my mother talking about this when it happened. I could be wrong on the well names as it certainly has been a number of years. Thank you again for the information.

If you have the original document that was recorded and not a copy you can write "corrected" at the top and send it to Garvin County to be recorded. It is amazing how many documents are recorded incorrectly, so I am not surprised. If you would like to send it to me I can take it to the courthouse and make sure it is recorded correctly. I go several days a week. You can make the check to Garvin County Clerk, $13.00 for the first page and $2.00 for each additional page.

Thanks so much for your generous offer to take these papers to the courthouse! I got to thinking over the weekend that perhaps I should call the 2 County Clerks directly and I did that this morning. I do not have the originals.......only copies. Grady County is sending me a certified copy, which I can then send to Garvin County and have it recorded properly. I was anticipating a difficult process, so am well pleased that this will be repaired with ease. Thanks again.
