I am hoping someone can give me some advice. We inherited rights from my dad a year ago. We did a probate in Michigan and filed heirship papers with the companies. Most rights have been transferred into our name. We have rights ( both RI and ORRI) in several Sheridan wells. They are sending us royalties in all of the wells where we have RI, however those wells that had an ORRI they are not. I have contacted them several times and sent every document that they have requested. I cannot get a call back or an e-mail. Aside from hiring an attorney what are my options?
Before calling an attorney, you might want to contact the OCC (figure out if you need to send it to Tulsa or OKC-check if there were Drilling and Spacing orders, pooling orders, etc to figure out which court) giving an exact list of the wells that you are having difficulty with and explaining the situation. Send the identical letter to Sheridan, send all by certified mail-return receipt. Send to the Division Order group, the Revenue group (not necessarily the same group) and explain that you are trying to clarify the situation immediately. See if that works before hiring an attorney.
Thanks. Sheridan provided a list of all the wells my dad had with them, when he past. All wells (RI and ORRI) were listed. I then sent it back to them with the ones circled (along with a copy of the check stub for proof) of those wells we aren't getting paid on. That is when they stopped returning calls. Frustrating. I will follow up with OCC.
They are a fairly small company. We only get paid every few months from them. They do not have to pay until the amount totals $25 or $100 (depending upon your Division Order), so this could be the issue. You should include a copy of the well list to the OCC, but try Sheridan one more time by certified mail (reserve a copy for the OCC if you need it later.) If the amounts are larger, then go full steam ahead.
Did you try the unclaimed funds for the state? I found some of ours there after a death.
I will try the unclaimed property site. I have not looked there for a while. The amount is over the minimum. In fact they are paying monthly on half the wells just not on all of them.
