Question on inherited minerals

My sister preceded my mother in death. I now have an oil company that is telling me I have to have my mothers will probated in Oklahoma to receive my sisters share. (Will was probated in Texas) where I live. Is this correct information? And if so, does anyone know a reputable attorney for this in Oklahoma. Only one oil company is doing this.

That is actually correct. It sounds archaic but each state has limited jurisdiction especially when it comes to land title issues. Fortunately the process is fairly simple and normally does not require travel to Oklahoma for out-of-state heirs. In most cases this can be wrapped up in about 60 days (+ or -) once the probate is filed.

Thank you for the information. Since it’s just one oil company and one small lease that is requiring this, I don’t think it’s worth probating the will in Oklahoma. Three other companies were fine with affidavit of heirship.

There is an uptick in drilling in Ellis County. If you run into difficulties, you may have to end up probating the will if the other company will not accept the affidavit.

Thank you so much for the information. It’s like a puzzle trying to figure this out. This oil company also shorted me on the bonus. I’m paying close attention even though it’s not a lot of money.

They may think you have less acres than you thought. Or there may be another reason. Follow up with them by certified mail so that you have a time line of every interaction. Keep copies of everything.
