Question on the confidential well list information release date

what does it mean when a permit is put on the confidential well list and it lists an information release date?
My minerals are in 157-91-6 and I believe the following wells 35096 and 35097 include my minerals. But not sure.

Any help would be appreciated

 DATE: JULY 5, 2018

DAILY REPORT: 17596

PERMITS APPROVED: #35096 - LIBERTY RESOURCES MANAGEMENT COMPANY, LLC, STANLEY W 158-91-30-6- 1MBHX, LOT1 30-158N-91W, MOUNTRAIL CO., 380’ FNL AND 608’ FWL, DEVELOPMENT, KITTLESON SLOUGH, 25139’, 9-5/8 INCH , 2356’ GROUND, API #33-061-04247

#35097 - LIBERTY RESOURCES MANAGEMENT COMPANY, LLC, STANLEY W 158-91-30-6-1TFHX, LOT1 30-158N-91W, MOUNTRAIL CO., 380’ FNL AND 573’ FWL, DEVELOPMENT, KITTLESON SLOUGH, 25184’, 9-5/8 INCH , 2356’ GROUND, API #33-061-04248

MBHX would be middle bakken horizontal.

TFHX would be three forks horizontal.

location of both: LOT1 30-158-91

it appears to me that these 2 wells are in T158N R91W section 30.

it appears to me that #35096 may be drilled but perhaps not #35097.

the 6 in the well name is maybe well #6 that is planned.

many times oil producers plan several wells in a drilling/spacing unit and name them #1-whatever #. when they decide to drill, they might choose something other than #1 well to begin. sometimes there is a well # and 2 wells intended to go there, so well #1 might have a three forks soil layer well and a middle bakken soil layer well.

#35096: 380’ FNL AND 608’ FWL means 380 feet from the north line (of the drilling/spacing unit)

#35967: 380’ FNL and 573’ FWL means 380 feel from north line and 573 feet from west line.

so both wells are probably on one ecopad, feet from each other.

you can get more information by asking for the exhibits on your case. you ask the department to send you the exhibits on docket case 26467.

https://www.dmr.nd.gov/oilgas/docketindex.asp

the docket might be the first notice of any activity. this is a nearby drilling/spacing unit. there will be a case requesting authority to set a certain # of wells in a drilling/spacing unit.

afterward, they often have a pooling hearing requesting that all mineral rights owners be pooled together for a particular well. you can see that these case were done on the same day.

you can request the exhibits for case 26467 by contacting the department of mineral resources.

march 22, 2018 docket

i think you should contact liberty resources:

the exhibits would include an economic analysis of the expected initial production of the well. wells decline significantly in the first year but they will probably indicate a 30-50 year production period, although horizontal drilling has only occurred in this area since 2006.

aqyre is one of their leasing partners if you have been contacted by them.

the department contact information:

Phone: (701) 328-8020 Fax: (701) 328-8022 Mail: NDIC Oil and Gas Division 600 East Boulevard Ave Dept 405 Bismarck, ND 58505-0840

it is likely that liberty resources has assigned you an ownership #. you will want to find out if your mineral deed is in order so that when payment is made for royalties, there is no impediment.

there is probably a liberty resources contact already assigned to this well, and maybe to this region.

good luck. suzanne hamlet shatto

Thank you for all of the information. Our latest lease is with aqyre. This is all new to me and trying to figure out what is going on. I really appreciate your help. I will contact the above as you suggested. We had all the probating done in both the state where my parents died and in North Dakota, so we should be good to go.

Sandy

Both wells have been spud and fracked at the end of November. They should be flowing back at this point though Liberty may not put you into pay for up to six months following date of first production. Will be very curious to see the results.

Thank you. So is that the possible information release date which is 6 months from end of November. What does the flowing back mean? I think that is what you said!!

Sandy.

Flow back means that the well will be producing and flowing back any frac water. The confidential status can be about two years. Each state has different rules. You will get paid your royalties even if it is confidential.

North Dakota law provides for a six month confidential window after being drilled. There are some different rules that allow operators to keep permits confidential and renew them on a yearly basis, but what that typically results in is the well coming off confidential status immediately after it starts producing vs. six months in the instance of Ms. Rule’s wells above.
