Quiet Title

When my mother passed away several years ago in Oregon, she had a Trust and Pour Over Will naming me as her beneficiary of anything in her name. I never knew she had mineral rights in North Dakota until I recently received a royalty check. Turns out my brother and sister somehow knew and filed a Quiet Title in 2010. He and my sister (both estranged from the family) are now sharing my mother's royalty income, where it should have been mine alone. Do any of you know whether a Quiet Title set in stone, or is it something that can be overturned with proof of inheritance and probate of my mother's will in that state? Thanks so much for any information you can offer.

In a quiet title action, all known heirs are supposed to be listed, and notified, or at least attempted to be notified of the quiet title action.

If you were not notified of the quiet title action, and no effort was made to notify you, you may have grounds to sue your siblings for the past royalties they collected.. You need to contact the operator of the lease(s) immediately and send them copies of the Trust and Pour Over Will. If anything, they will suspend payments until the title issue is cleared up. Someone on here with more North Dakota experience can probably provide much better detail. You will have some legal work to do in North Dakota to get the mineral ownership properly recorded to your name.
