RE: Question about withheld royalties

Good morning everyone,

I have researched this without much luck and wanted to seek an opinion. I own a mineral interest in a couple wells that have been producing for over 18 months now. I have yet to receive a royalty check or division order, despite contacting the operator multiple times. They claim to be having delays in getting the Title Opinion, but I feel that even the most complicated title shouldn’t take 2 years to complete, especially after the well has been spud.

Do I have any recourse here?

Send your requests by certified mail return receipt asking for clarification of title and requesting interest payments. The date of first sales is the critical date, not the spud date. The request for interest (although small in Texas) should get their attention.
