I have mineral rights in Oklahoma and I use to get a lot of offers to buy them. They would send Mineral Deeds and bank drafts in the mail and I would never respond because I wasn't interested in selling.
Recently I was on the OKCounty Recorder website and there is a signed Mineral Deed with someone else signing their name above my name and social security number. We have similar names but it was to my minerals! I still have the Mineral Deeds that I use to receive, bank draft and all still in the envelope. This document was also notarized! What can I do to get my Mineral rights back and possibly get reimbursed some of the money after all of these years? Why would a notary even put a stamp on something so obviously not correct?
Any advice or information would be greatly appreciated.
Thank you,
Julie C.
You need to immediately contact an attorney to get the correct paperwork filed. You may have to file a lawsuit against both the buyer and the seller and then file a lis pendens to prevent any transfers to third parties. Or there may be another preventative measure to make sure that there is a hold on title to the minerals. The disturbing thing is that you mention 'after all of these years'. You will have a lot more difficulty if this is not a recent transaction.
No, it was not recent , it was over 10 years ago. I don't know much obviously about this stuff and when I found that okcounty recorder website I saw and found a lot of info. I do know that the operator is still around, he bought mineral rights from my sisters daughter. Can I at least get them put back in my name? It's clear for anyone to see what was done.
Are you in Oklahoma? As TennisDaze said, if this has gone on for years you are going to have a bigger problem getting it straightened out. My best advice is to get all the info you can, copy of deeds etc. online from the county clerks office where your minerals are located. You said you saw the transfer on the County Clerks website so download those documents. They you are going to need a lawyer familiar with minerals/oil & gas. Good luck.
Julie,
I had a similar thing happen several years ago. A company in Denver had filed they owned my minerals and sold them to a guy in Houston. I hired Cody, an oil & gas attorney and he was able to get them back. But, I found this out within a year. Since it's been so long, it's going to a lot harder to get them back. If you need a good OK attorney, friend me and I will give you the name of one or two.
I'm in Colorado but have family in Oklahoma, thank you for your response!
