State of North Dakota taking minerals with"high water mark resolution"

We have mineral deeds for areas south of Williston that ended up in the low water mark area. With the decision of the court in North Dakota we find that these mineral acres on which we hold the mineral deeds are going to belong to the state of North Dakota...My concern is do we just loose these mineral acres or will the state have to pay us for the mineral deeds which we purchased many many years ago and they so conviently acquired through the court decision...If they take land from a land from a land owner by condemning it they have to pay the land owner fair market value for the deeds on that land so does it work the same for mineral deeds

J Anderson,

Do you have legal reference available? This development may have a significant effect on some clients with minerals in both McKenzie and Williams Counties.

If you go to The Bismarcktribune.com high water mark story you will find information on the deceision...The decision was handed down in January of 2014...We held minerals in six sections south of Williston along the Missouri River and have a mineral interest in the Williston well 18311...J anderson
