Hello, All:

We sold 240 surface only acres in Canadian County, OK. Now we need to transfer the Mineral Rights from the family trust into an LLC.

Are there any recommendations on how this is done in Canadian County?

Any recommendations on Title companies or Attorneys that can/will do this?

Lastly, they are producing rights. When do we notify the producer (assuming after the transfer, but want to make sure) to change the payee (from family trust to LLC)?

John A. “Andy” Bass with Bass Law Firm in El Reno could prepare and file the deed for the transfer. Then you can send a copy of the deed to the payors on the well(s). Check the company website or call Owner Relations for instructions on what paperwork they require. They will eventually send you a new division order and request a W-9 from you for the LLC.

Any attorney licensed in Oklahoma can handle this transaction, not just one in Canadian County. A-Monty is correct that you will need to contact the producers so that they make checks payable to your LLC.
