The process varies by state. For instance, in Oklahoma for funds over $10k in unclaimed property a probate is required.

Ethan, I agree with Rick. But to add something to the discussion, oil and gas (or mineral) rights are real property. So, they are for the most part handled just like real property, being surface property. They would be transferred like you would transfer surface property if the decedent owned real estate.
