My grandfather entered into a ROW agreement with Transok Pipeline in 1973. There are no details on how much surface use was granted, only as “reasonably necessary”. The wording states it is a perpetual agreement, but does not indicate permanent. Now, 46 years later, Enable Midstream wants to widen the road and enlarge the pad site. How do we go about negotiating this since there were no stipulations in the original agreement?
How is Enable Midstream claiming rights to the ROW? This appears to be very different from a pipeline. You should engage the services of an attorney who deals with pipeline/eminent domain issues.
Through a long series of acquisitions, Transok is no longer in operation and Enable Midstream now owns the ROW.
