We’ve been offered 200/p/rod for a 17.7 rod connection for a water pipeline. Is this fair market price for water connection? Is there a “standard” language document for a Right of Way Agreement? Agreement defines a 30’ wide easement and a 20’ temporary parallel easement for maintenance, repair, inspecting, fences, electrical services, removal, etc… Who generally owns the land the water pipeline rests on after the agreement is signed? Thanks in advance
This is a contract between you (surface owner) and the company. There is no standard contract but there are some standard clauses you will want in it. You should contact a lawyer to draw up the paperwork (look at tab “Directories”) I would make it a non-exclusive, term (10 year but evergreen, so you are paid again in 10 years) agreement. I would not give them 30 feet for a waterline. Best of luck.
