On 8/14/23 I received a letter from Ovintiv USA (via Lonewolf Energy) that contained a proposal for a well in Duchesne County, Utah. This came out of absolutely nowhere. I have emailed Lonewolf; they sent me copies of grant documents that show a Henry A. Johnson as grantee, but Lonewolf hasn’t explained how they found out that the HA Johnson in my family tree is the same one as the grantee.
Ovintiv has offered a lease that includes “Lessor hereby warrants and agrees to defend the title.” I don’t see how I can agree, given that I have no title documents and the source of my alleged inheritance is ambiguous. I’m operating on a time limit of 25 more days, before being deemed a non-consenting party under Utah Code Ann. 40-6-6.5(4)(d)(i)(D). So I don’t think a landman would have time to sort this out for me.
Advice?
Cross the clause out and initial it and send it in by certified mail RRR.
