I own surface and minerals (S25-16N-10W) where an oil well site is located. I do not receive any royalties because it is an out of section well site. Am I entitled to any compensation from Devon Energy since they are using my land in the production process. Does anyone have any experience with this?
You should have settled on surface damages before the well was drilled.
There are sites for O/G Production. You need to state the State you’re referring to. As for your question royalties are paid from the section producing the minerals. If your property is the top hole only, then no, you aren’t entitled to royalties unless stipulated in your lease. Devon is notorious for top holes that are not in the production sections. This is common in horizontal wells. My experience.
